NOTICE OF PUBLIC HEARING
COMMITTEE OF ADJUSTMENT
APPLICATION FOR MINOR VARIANCE & CONSENT
Planning Act, R.S.O. 1990, c. P.13, as amended – Sections 45(5), 45(6) & 53(5)
August 20, 2025, at 6:00 p.m.
Synopsis of Proposal: To permit a boundary adjustment involving the transfer of approximately 0.74 hectares of land from 3030 Concession Road 3 to 3122 Concession Road 3, associated Minor Variances to Zoning By-law 03-57 are required to recognize a reduced lot area of 26.77 hectares for the agricultural lot at 3030 Concession Road 3 (minimum 36 hectares required) and an increased lot area of 9.55 hectares for the residential lot at 3122 Concession Road 3 (maximum 1 hectare permitted).

This meeting will be live streamed by the municipality through our iCompass portal.
A copy of this Notice has been circulated to all assessed property owners within 60 metres of the subject property, as per the current Assessment Roll. An attached Location Map identifies the general location, and Site Plan shows the proposed Minor Variance and Boundary Line Adjustment.
You are entitled to attend the hearing in person to express your views. You may also be represented by an agent or legal counsel. If you are aware of someone who may be interested in or affected by this application and who has not received a copy of this Notice, please inform them of the hearing.
Additional information regarding the application is available for review at the Municipal Office during regular business hours.
Appeal Rights
The applicant, a specified person (as defined by the Planning Act), a public body (as defined by the Planning Act), and a registered owner of land to which the by-law would apply, each have the ability to appeal a decision of the Committee of Adjustment of the Township of Adjala-Tosorontio on a Minor Variance Application and Consent to the Ontario Land Tribunal (OLT).
If a person or public body would otherwise have an ability to appeal the decision of the Council of the Township of Adjala-Tosorontio to the OLT but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Adjala-Tosorontio before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the OLT unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED MINOR VARIANCE & CONSENT A/19/25 & B/12/25
This adjustment is proposed to resolve encroachment issues. Both properties are zoned rural; the lot at 3030 Concession Road 3 is used for grape vine cultivation and residential purposes, while the portion being transferred is not currently used for agriculture. The lot at 3122 Concession Road 3 is used solely for residential purposes. The land to be adjusted is located at the rear of 3122 Concession Road 3 and along the side and northern boundary of 3030 Concession Road 3.
